به اپلیکیشن و خدمات اینترنت اشیای ماندگار مدار آوین خوش آمدید. استفاده از این اپلیکیشن، تجهیزات، سامانه‌های ابری، وب‌سایت و سایر خدمات ارائه شده توسط شرکت ماندگار مدار آوین (MMAV) به منزله پذیرش کامل شرایط و ضوابط زیر است.

در صورت عدم موافقت با هر یک از مفاد این سند، لطفاً از استفاده از خدمات خودداری نمایید.

1. تعاریف

• «شرکت» به ماندگار مدار آوین (MMAV) اطلاق می‌شود.

2. شرایط استفاده

کاربر متعهد می‌شود:

• اطلاعات صحیح و معتبر ارائه نماید.
• از حساب کاربری خود محافظت کند.
• از خدمات در چارچوب قوانین کشور محل استفاده بهره‌برداری نماید.
• از هرگونه سوءاستفاده، نفوذ، اختلال یا تلاش برای دسترسی غیرمجاز خودداری کند.

3. مالکیت معنوی

کلیه حقوق مالکیت معنوی شامل:

• نرم‌افزارها
• طراحی‌ها
• مستندات
• علائم تجاری
• لوگوها
• پایگاه‌های داده

متعلق به شرکت ماندگار مدار آوین بوده و هرگونه کپی‌برداری، مهندسی معکوس، انتشار یا استفاده تجاری بدون مجوز کتبی شرکت ممنوع است.

4. دسترسی به خدمات

شرکت تلاش می‌کند خدمات را به صورت پایدار ارائه دهد، اما تضمینی در خصوص دسترسی دائمی و بدون وقفه وجود ندارد.

شرکت می‌تواند برای تعمیرات، ارتقاء، مسائل امنیتی یا شرایط خارج از کنترل، بخشی یا تمام خدمات را به صورت موقت متوقف نماید.

5. مسئولیت کاربر

کاربر مسئول موارد زیر است:

• حفظ امنیت نام کاربری و رمز عبور
• پیکربندی صحیح تجهیزات
• امنیت شبکه محلی و اینترنت مورد استفاده
• تهیه نسخه پشتیبان از اطلاعات مهم

6. محدودیت مسئولیت

شرکت در قبال موارد زیر مسئولیتی نخواهد داشت:

• قطع اینترنت یا اختلالات مخابراتی
• خرابی ناشی از نصب یا استفاده نادرست تجهیزات
• خسارات ناشی از حملات سایبری خارج از کنترل شرکت
• از دست رفتن داده‌ها به دلیل عوامل خارج از اختیار شرکت
• خسارات غیرمستقیم، تبعی یا تجاری

حداکثر مسئولیت شرکت در هر شرایطی از مبلغ پرداخت شده توسط کاربر برای همان خدمت تجاوز نخواهد کرد.

7. استفاده غیرمجاز

موارد زیر ممنوع است:

• تلاش برای نفوذ به سامانه‌ها
• استخراج غیرمجاز داده‌ها
• مهندسی معکوس نرم‌افزار
• ایجاد بار غیرعادی روی زیرساخت‌ها
• استفاده از خدمات برای فعالیت‌های غیرقانونی

در صورت مشاهده تخلف، شرکت می‌تواند حساب کاربر را تعلیق یا مسدود کند.

8. به‌روزرسانی نرم‌افزار

شرکت می‌تواند برای بهبود عملکرد، امنیت یا افزودن قابلیت‌های جدید، نرم‌افزارها و Firmware تجهیزات را به‌روزرسانی کند.

برخی به‌روزرسانی‌ها ممکن است به صورت خودکار انجام شوند.

9. خدمات شخص ثالث

ممکن است برخی قابلیت‌ها از سرویس‌های شخص ثالث استفاده کنند. شرکت مسئول عملکرد، امنیت یا دسترس‌پذیری این سرویس‌ها نخواهد بود.

10. خاتمه خدمات

شرکت می‌تواند در صورت:

• نقض شرایط استفاده
• استفاده غیرقانونی
• تهدید امنیت سامانه

دسترسی کاربر را محدود یا قطع نماید.

11. تغییر شرایط

شرکت حق دارد در هر زمان این شرایط را اصلاح کند. ادامه استفاده از خدمات پس از انتشار نسخه جدید به منزله پذیرش تغییرات خواهد بود.

12. قوانین حاکم

این شرایط مطابق قوانین و مقررات جاری قابل تفسیر و اجرا خواهد بود.
